These Terms & Conditions govern all sales, rentals, services, and related transactions carried out by Off Road World (“the Company”, “we”, “our”) with customers (“the Customer”, “you”). By purchasing, renting, or using any product or service from Off Road World, you agree to these Terms & Conditions.

1. Company Information

2. Scope of Services

Off Road World provides:

Sale of ATVs, UTVs, quads, and related vehicles
Parts, accessories, and gear
Maintenance, servicing, and repair
Rentals and guided tours (if applicable)

All services and products are subject to availability and may change without prior notice.

3. Eligibility

To purchase or rent an ATV, Customers must:

Be at least 18 years old
Present valid identification
Hold the required driving licence for the vehicle category under Spanish law (if applicable)

The Company reserves the right to refuse service to anyone not meeting legal or safety requirements.

4. Prices & Payment

4.1 Pricing
All prices are listed in euros (€) and include VAT unless stated otherwise.
Prices may change without prior notice.

4.2 Payment Terms
Accepted payment methods include:

Cash
Credit/debit cards
Bank transfer

Full payment must be made before vehicle delivery, rental departure, or service completion.

4.3 Deposits
Some services (especially rentals or vehicle orders) may require a non-refundable deposit, specified at the time of booking or purchase.

5. Vehicle Sales

5.1 Orders and Availability
Vehicle orders are subject to manufacturer availability. Estimated delivery times are not guaranteed.

5.2 Vehicle Condition
New vehicles include manufacturer warranties.
Used vehicles are sold “as is” unless otherwise stated in writing.

5.3 Registration & Documentation
Costs of registration (matrícula), taxes, and insurance are the responsibility of the Customer unless explicitly included in the sales contract.

6. Rentals (if applicable)

6.1 Rental Requirements
Renters must sign a rental agreement and comply with all safety instructions.

6.2 Security Deposit
A refundable deposit may be required. The deposit may be partially or fully withheld for:

Damage to the vehicle
Late return
Violation of the rental agreement

6.3 Responsibility for Damage
Customers are fully responsible for damage caused by misuse, negligence, or violation of traffic regulations.

6.4 Prohibited Use
Vehicles may not be used for:

Illegal activities
Racing or competitions
Riding under the influence of alcohol or drugs
Carrying passengers where not permitted

7. Warranty & Repairs

7.1 Manufacturer Warranty
New vehicles are covered by the official manufacturer’s warranty. Warranty claims must comply with manufacturer terms.

7.2 Service Warranty
Repairs performed by Off Road World include a limited warranty on workmanship for a specific period (to be specified on invoice).

7.3 Exclusions
Warranty does not cover damage caused by:

Misuse or improper maintenance
Accidents
Modifications or repairs by unauthorised personnel
Wear and tear items (brake pads, tyres, belts, etc.)

8. Cancellations & Refunds

8.1 Sales
Vehicle sales are final once delivery is accepted.
Deposits for ordered vehicles are generally non-refundable unless the Company fails to deliver the vehicle.

8.2 Rentals
Cancellation policies depend on the rental agreement.
No-shows or same-day cancellations may result in full charges.

8.3 Services
Service cancellations must be communicated in advance.
Completed labour and installed parts are non-refundable.

9. Liability

Off Road World is not liable for:

Damages resulting from improper use of purchased vehicles
Personal injury resulting from failure to follow safety instructions
Delays due to events outside our control (weather, supply chain issues, etc.)

Customers assume all risks associated with ATV operation and agree to comply with Spanish traffic and safety laws.

10. Customer Responsibilities

Customers agree to:

Use vehicles safely and responsibly
Follow all instructions provided by the Company
Ensure proper maintenance of purchased or rented vehicles
Return rental vehicles in the condition received (normal wear and tear accepted)

11. Data Protection (GDPR Compliance)

Off Road World Andalucía collects and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish data protection laws.
Customer data will only be used for service delivery, billing, legal compliance, and internal marketing (if consented).

Customers may request access, correction, or deletion of their data by contacting the Company.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by Spanish law.
Any dispute shall be submitted to the courts of Andalucía, unless otherwise required by consumer protection regulations.

13. Modifications to Terms

Off Road World Andalucía reserves the right to update or modify these Terms & Conditions at any time.
Changes take effect once published on our website or communicated to the Customer.
